Federal law in Russia expands accountability and oversight for digital innovation and AI testing

On 4 January 2025, Russia introduced the Federal Law on Digital Innovation and Artificial Intelligence in Experimental Legal Regimes (FZ No. 169/Bill No. 512628-8).

This forward-thinking federal legislation provides a structured framework for testing digital innovations and addresses the challenges posed by AI-related incidents.

One of the most notable aspects of the law is its focus on accountability for AI-related damages. The legislation establishes clear mechanisms to identify and hold individuals responsible for incidents caused during AI testing.

This includes the creation of a dedicated commission tasked with addressing disputes and determining responsibility in cases of damage linked to AI systems.

By prioritising transparency in the resolution of such disputes, the law aims to build trust among stakeholders, including developers, regulators, and the public.

Broadening the Scope of Liability

Under the new framework, the scope of liability during experimental testing has been expanded. Developers and organisations involved in digital innovation projects are now held to stricter standards of accountability.

This broadening of liability ensures that damages incurred during experimental phases are not overlooked, safeguarding the interests of all parties involved.

These changes are designed to strike a balance between encouraging innovation and maintaining public safety and legal fairness. By clarifying responsibilities, the law removes ambiguities that could otherwise stall digital innovation projects.

To promote efficiency in digital innovation, the federal law eliminates certain bureaucratic hurdles.

For instance, initiators of experimental regimes are no longer required to have a clean criminal record—a provision that had previously limited the pool of eligible participants. This adjustment opens doors for a wider range of innovators to contribute to Russia’s digital development.

Additionally, the validity periods of experimental legal regimes have been extended. This change gives developers more time to refine and test their projects, fostering a more thorough and sustainable approach to innovation.

Strengthening Oversight for AI Testing

The federal law also introduces robust tracking mechanisms to monitor AI-related incidents. These systems help identify and analyse issues that arise during experimental testing, enabling authorities to intervene when necessary.

Such oversight reduces the risk of unresolved disputes and provides a safeguard for both developers and users.

The commission established under the new law plays a central role in these processes. By mediating disputes and providing authoritative rulings, the commission ensures that AI testing adheres to ethical and legal standards.

A Catalyst for Digital Innovation

Russia’s new law reflects a commitment to fostering digital growth while addressing the risks associated with emerging technologies. The framework not only supports the development of cutting-edge AI and digital tools but also reinforces accountability and governance.

By streamlining processes and providing clear guidelines for experimental regimes, the legislation encourages innovation in a controlled and efficient manner.

This balance of innovation and regulation positions Russia as a key player in the global tech landscape, ready to tackle the challenges of the digital age.

The implementation of this law is expected to strengthen confidence in Russia’s digital ecosystem. Developers are offered a supportive environment to test and refine their ideas, while stakeholders and the public benefit from enhanced safeguards and accountability measures.
